  At a seminar organised by The Actuarial Profession a speaker from the FSA stated that the Policy Statement relating to CP11/05, which had been expected in December, will not now appear before February 2012. The proposed consultation paper on communications to with-profits policyholders is likely to be delayed until the second half of 2012.

  The FSA is keen to ensure that firms do not view this as a relaxation of the rules and that they maintain momentum in its implementation. There is no change for non-directive firms in that the FSA will consider its regulatory approach when there is greater clarity within the scope of the Directive.   In late October 2009 the FSA sent a letter to Compliance Officers concerning the rates to be used in illustrations required on sales of products covered by the Conduct of Business Sourcebook (COBS). The letter was sparked by an investigation conducted by the FSA into advice given on pension switching, particularly where cash funds were considered. However, these rules have much wider application and the FSA requires all firms to consider their compliance with the rules.

Many respondents to the consultation were concerned that the rationale for a separate standard was not strong enough, that there was insufficient content and that it could lead to unnecessary duplication with other standards. Accordingly BAS has decided not to progress its proposals in this area.

The name is to be the Financial Conduct Authority (FCA).
